Our Terms & Conditions
Please read these product terms and conditions carefully, as they affect your rights and liabilities under the law and set out the terms under which Kimberspring makes the products available to you ("Trading Terms").

Prices and Descriptions
The prices payable for the items that you order are clearly set out in the web site. No VAT is payable unless otherwise stated. Postage & packing to UK mainland destinations are included in the prices quoted on the website . A small delivery charge will be levied for commissioned items over £400 due to carriage insurance - the amount for this will be confirmed before the order is completed.

Every care has been taken to ensure that the descriptions, specifications and colours are a realistic representation of the actual product. Kimberspring products are handcrafted and use antique, vintage and reclaimed products plus some natural materials for certain items, therefore slight variations in shape and size may arise.

Acceptance
On receipt of your order, we will send you an Order Acknowledgement - please check that all the details are correct and we have understood your order correctly.

There will be no contract of any kind between you and us unless and until we actually dispatch the goods to you. Your order is an offer to buy from us. Nothing that we do or say will amount to any acceptance of that offer until we actually dispatch the goods to you. At any point up until then, we may decline to supply the goods to you without giving any reason. At the moment that the goods are dispatched (and not before), a contract will be made between you and us.

Payment
Cheques should be made payable to J. Kimber with the purchasers address written on the back. We require the cheque to be cleared before the goods can be released. You may also pay by BACS transfer - contact us for our payment details on 01305 760782 . A receipt will be emailed to you once your funds are cleared .

Delivery
The anticipated delivery period will be shown on your Order Acknowledgement (normally 14 - 28 days) and this is the time envisaged for us to make your item in our studio . Specially commissioned items may take longer however we will confirm a delivery date once the order is confirmed . Postage & packing to UK mainland destinations are included in the prices quoted . A small delivery charge will be levied for commissioned items over £400 due to necessary carriage insurance - the amount for this will be confirmed before the order is completed. Delivery will be made to the address specified by you on the completed order form. All deliveries are by Royal Mail or a courier selected by us.

We do our utmost to secure delivery within 14 - 28 days of the date of your order. Kimberspring cannot be held responsible for delays caused by manufacturers, carriers or their agents. We make every effort to meet the estimated delivery period quoted on the order confirmation, however, we cannot accept liability for any consequential loss. If we cannot deliver within this time we shall notify you immediately and try to agree an alternative date with you. If we cannot agree an alternative date, you will be offered a refund of the cost of the goods including the delivery charge.

If you order items with different availability dates, all the items will be held until the last item is available .

Returns and Refunds
Goods will be accepted for return if received in the same condition as dispatched within ten days and in the original packaging for a refund subject to a 20% re-stocking charge. Commissioned or made to order items cannot be returned unless found to be faulty.

Goods damaged in transit must be reported to Kimberspring within 48 hours of receipt. Claims for a refund can only be approved once the goods are received in our studio. Please write to us explaining the nature of the problem, carefully re-pack the item in its original packaging, and return to us using an insured delivery service. Please obtain a receipt from the Post Office as we cannot take responsibility for goods lost or damaged in return post.

Cancellation
If you wish to cancel your order prior to dispatch please advise Kimberspring by post, by fax (on 01305 760782) or e-mail (at designs@kimberspring.co.uk) The cancellation penalty charge is 25% of the total price quoted on your order. In the event that the goods have already been dispatched at the date of receipt of your cancellation of the order, you must return the goods to us and we will refund the price of the goods minus the penalty within 30 days, beginning with the day on which notice of cancellation was given. The cost of return carriage must be borne by you. Failure to deliver by the specified time is not permissible grounds for cancellation without penalty.

Non-Availability
If, for any reason, we are unable to supply a particular item, we will notify you as soon as possible. You will be refunded the cost of the goods and may choose to cancel the whole order within 30 days.

General
These Trading Terms shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts.

If any of these Trading Terms is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Trading Terms which will continue to be valid and enforceable to the fullest extent permitted by law, provided any contract made under these Trading Terms is capable of continuing in existence.
